Businessman's corruption case ends in probation

A businessman who pleaded guilty to paying $9,000 in bribes to a Chicago alderman was spared a prison sentence Thursday because of his failing health.

Wafeek "Wally" Aiyash, 51, who underwent a kidney transplant in 2009, was sentenced to one year of home detention and five years of probation and fined $50,000.
Aiyash, of Naperville, had pleaded guilty to offering to pay then-Ald. Isaac Carothers $100,000 for help in opening restaurants at O'Hare International and Midway airports. But Carothers had earlier been caught corruptly taking payoffs from a developer in a separate matter and agreed to work undercover for authorities. Aiyash was secretly recorded as he delivered at least one of two bribes totaling $9,000 to Carothers, authorities said.

"We certainly have had our disgusting share of public corruption over the years," said U.S. District Judge John Darrah, who imposed the sentence.

Prosecutors sought three years in prison, but the judge agreed with Aiyash's lawyers that he was too sick for prison.

Prison would be "life-threatening," said Dan Rubinstein, Aiyash's lawyer.

Carothers is serving a 28-month sentence in prison.
