Nearly 10 months after his release from prison, a man convicted three times of the 1992 rape and murder of an 11-year-old girl in spite of DNA evidence excluding him as her attacker filed suit Tuesday against law enforcement officials in Lake County, alleging they framed him.
ReplyDeleteThe federal lawsuit comes in the case of Juan Rivera, who spent two decades in prison for the murder of Holly Staker, one of four violent felonies in which Lake County prosecutors insisted on a suspect's guilt even after forensic evidence indicated his innocence. The cases put prosecutors on the defensive for their reluctance to acknowledge the meaning of DNA, and all four prosecutions collapsed between August 2010 and May 2012.
"Juan Rivera lost 20 years of his life," said Locke Bowman, legal director of the MacArthur Justice Center at Northwestern University's law school and one of Rivera's lawyers. "This was not an accident. ... He was incredibly vulnerable, and the police took advantage of him."
At the heart of Rivera's lawsuit is the allegation that police coerced him into falsely confessing. They allegedly interrogated him repeatedly over four days during which Rivera had little sleep, and they allegedly took advantage of his low IQ, his difficulty with English and a psychological breakdown he suffered while in custody.
Police allegedly fed him details of the crime, according to the lawsuit, even though they knew that when it occurred, Rivera was on electronic monitoring for an unrelated crime and could not have murdered Staker.
James Sotos, an attorney for the state's attorney's and sheriff's offices, called the allegations "offensive and untrue." He said police and prosecutors acted "appropriately and with integrity" and made a good-faith effort to solve the crime. Sotos expressed confidence they would be vindicated.
"The evidence in the case clearly provided probable cause and a good-faith basis for the arrest of Mr. Rivera," Sotos said. "And three separate juries of 12 heard all the evidence in the criminal case, which included Mr. Rivera's own confession, and unanimously found him guilty beyond a reasonable doubt."
In 1992, Rivera was in jail for burglary when police began to focus on him as a suspect in the death of Staker, killed as she baby-sat two children in Waukegan. After police got his signature on a written confession, Rivera was convicted three times, the last time in 2009, in spite of DNA evidence that did not match his genetic profile and suggested that someone else had stabbed and raped Staker.
Prosecutors explained the DNA by saying Staker, though she was only 11, must have had consensual sex with someone else; they said Rivera's confession showed he killed the girl.
In December 2011, the Illinois Appellate Court threw out Rivera's conviction and barred prosecutors from trying him again, citing the DNA and questionable tactics used in the interrogation. Rivera went free the next month after prosecutors decided not to challenge the ruling.
At a news conference, Rivera said he is trying to get his life back and filed a lawsuit so others would not have to endure what he did.
"It's not just about me," he said.
The lawsuit names more than a dozen officers, State's Attorney Mike Waller and four top assistants, and several municipalities whose officers worked on the Lake County Major Crimes Task Force as it investigated Staker's murder. It also names John E. Reid & Associates, a Chicago firm that pioneered interrogation techniques. Investigators interrogated Rivera at the company's offices and, according to the lawsuit, at least one company official took part in the questioning.
The president of John E. Reid & Associates was out of the office and could not be reached, an employee at the firm said.
The suit also alleges that some of the defendants defamed Rivera with public statements about him.

ReplyDeleteI've heard the horror stories about Chicago and the ONLY reason I'd step into that criminal cesspool you call a city is to see my Bears play. Their pro ballers aren't even safe there (i.e., the recent home invasions of two NBA players)! Once the game is over, I'm high tailing it out of there! I don't blame Chicago's cops for delivering the beat down to some of their citizens.
Detroit PD had the bad rap of being the most trigger happy cops, but clearly Chicago has taken that crown and I'm GLAD.

You're referring to a period 14 years ago (and you probably got lost , ending up in one of our Chi-town Southside imitation 'hoods, lol). I'm talking about Chicago of last YEAR. No city is perfect, but you can't seriously think the current wave of Chicago PD corruption is something to be proud of. It's a reflection of your city and that's not good, no matter how you try to spin it.
It took the feds to step in on Detroit and New York's PDs' corruption problems and that's what is needed for Chicago PD. No tourist (or resident)will feel safe in a city of crooked cops.
chicago cops are so corrupt it is disgusting. A large group of us were at a bar and the bouncers got pissed off because we were taking too long to get our coats from the coat check. The problem had to do with their crap system more so than any of us. Next thing bouncers start beating up my friends and the cops slam a skinny indian kids head into the wall and punch another guy across the face. We're business school students, nerds who overachieve my studying too much and cops are going to throw us into a wall???? are you kidding me?? that's just plain stupid. you'll read an editorial about it all soon enough. they grabbed some of the nicest guys i've ever met and treated them like criminals.. chicago sucks and so does its police force, bunch of a*holes

ok everyone listen,a few days ago i was bought a few crack rocks and the cpd pulled up and got me for them but didnt take me to jail.they said if i helped them pop this guy who sold to me and any other drug dealer i know they would not arrest me and they didnt because i agreed.so now im just waiting for the call when they want me to start setting people up.im worried that they will just use me for whatever info they can get then arrest me for the rocks i originally had..can they do that??should i go to the da or something and just come clean or what?does anyone have any advice at all??

Sorry for the loss of the family but after hearing it happen on the police scanner there was no way that police officer shot that kid just to shoot at him. No way that kid was a good kid! He was robbing someone! And then ran from the police! Why do they have witnesses then?!?! Why did people hear it for themselves on the police scanner and was told the same on the news. Like I said sorry for your loss but as much as you think that your brother could not be that person it was heard over the police scanner! You can't deny that proof! He had every opportunity to give up and drop to the ground but he seemed to continue by shooting at the police officer! If anyone shot at you and put your life at risk I'm sure you would do anything to protect your life! Wouldn't you? That officer was just doing his job in chasing a person that had a gun but after that kid decided to fire at the police officer he did exactly what he was trained to do to protect himself! Your brother had the opportunity to drop to the ground but he didn't. You play with fire, then be ready of the possibility to get burnt! Your family could sue all they want but Im sorry to say that the proof is obvious and no way anyone could change that. And you shouldn't be telling lies about him not having a record just to try to make it seem like your brother was a clean kid.
